Agreement
These Terms of Service are between you and Makwa Ventures Inc., operating as Makwa Aerial. By using the website, submitting a quote request, creating an Academy account, buying a course, paying an invoice, or booking services, you agree to these terms.
If you are using the site or services for an organization, you confirm that you are authorized to act for that organization.
Website Use
You may use the website for lawful personal or business purposes. You must not interfere with the site, attempt to access private areas without authorization, misuse forms, submit false information, copy restricted Academy content, or use the site in a way that harms Makwa Aerial, customers, students, or service providers.
Quote Requests and Bookings
Submitting a quote request does not create a booking, guarantee service availability, lock pricing, or confirm that a flight can be completed. Makwa Aerial reviews each request before confirming scope, timing, price, deliverables, site requirements, and next steps.
A booking is confirmed only when Makwa Aerial confirms it in writing and any required deposit, payment, site information, or authorization has been received.
Drone Service Conditions
Drone services are subject to safe weather, lawful operating conditions, Transport Canada requirements, airspace restrictions, site access, owner permission, privacy considerations, equipment readiness, pilot discretion, and any other safety or legal requirement that applies at the time of flight.
Makwa Aerial may reschedule, modify, delay, decline, or stop a flight if conditions are unsafe, unlawful, impractical, or outside the agreed scope.
Customer Responsibilities
You are responsible for providing accurate information and reasonable cooperation, including:
- Correct contact, billing, property, and project information.
- Permission to access and operate from the property or site where required.
- Disclosure of hazards, access issues, sensitive areas, privacy concerns, or restrictions.
- Any client-side approvals, permissions, or notices required for your project.
- Reviewing deliverables promptly and raising concerns within the timeline provided in the quote or invoice.
Deliverables and Use Rights
After full payment, customers receive permission to use the purchased deliverables for the agreed project or ordinary business purpose described in the quote. Unless otherwise agreed in writing, Makwa Aerial retains ownership of original media, project files, templates, methods, training materials, and intellectual property created or used to provide the service.
Makwa Aerial will not use private client project media in public marketing without permission or written agreement.
Payments, Taxes, and Invoices
Prices are in Canadian dollars unless stated otherwise. Applicable taxes, including GST/HST where required, may be added at checkout or invoice. Payments may be processed through Stripe or another approved payment method. Makwa Aerial does not store credit card numbers.
Course access, service scheduling, certificate delivery, and final deliverables may depend on successful payment confirmation. Payment status is verified through payment provider records, not only through a return page or email.
Drone Essentials Shop
Drone Essentials products may include Makwa Aerial merch and field accessories. Products are processed after payment, and made-to-order items are produced after purchase.
Physical products and merch may ship separately from course access, and timelines may vary by item, production schedule, carrier, destination, weather, and product availability.
Cancellations, Rescheduling, and Refunds
Weather, safety, access, airspace, or legal conditions may require rescheduling. If Makwa Aerial reschedules for safety or operating reasons, we will work with you to choose a practical new time.
Service deposits, cancellation terms, and refund eligibility may vary by quote, project type, travel, scheduling commitment, and work already completed. Academy course purchases are digital training products. Course refunds are generally not available after access has been used, a substantial portion of content has been viewed, or a certificate has been issued, except where required by law or approved by Makwa Aerial for a duplicate purchase, billing error, or technical access problem. Physical product returns depend on product condition, customization, timing, and whether the item has already been produced or shipped.
Makwa Aerial Academy
Academy content is provided for training and preparation. It is not legal advice, a Transport Canada pilot certificate, a flight review, an airspace authorization, insurance advice, or permission to operate a drone. Students remain responsible for understanding and following the laws, safety requirements, operating conditions, and manufacturer instructions that apply to their own flights.
Academy accounts are for the registered user only. You must not share login credentials, resell access, copy course content, scrape lessons, publish answer keys, or represent Academy completion as an official government licence.
Certificates
Makwa Aerial Academy certificates confirm completion of Makwa Aerial training content only. Certificates are not government-issued drone licences, proof of a flight review, insurance approval, or authorization to fly in restricted or controlled airspace.
Account Security
You are responsible for keeping your login credentials secure and for activity under your account. Makwa Aerial may suspend or restrict access if we believe an account, payment, certificate, quote request, or admin area has been misused or accessed without authorization.
Third-Party Services
The website and business may use third-party services such as Stripe, email providers, hosting providers, mapping resources, and linked external websites. Those services may have their own terms, privacy policies, security practices, and availability limits. Makwa Aerial is not responsible for third-party websites or services outside our control.
No Professional Advice or Guaranteed Outcome
Drone imagery, site documentation, thermal-capable documentation, and Academy training are informational and visual services. They do not replace legal, engineering, surveying, roofing, electrical, building, insurance, emergency, or other qualified professional advice. Makwa Aerial does not guarantee a specific business, regulatory, inspection, or exam outcome.
Limitation of Liability
To the maximum extent allowed by law, Makwa Aerial is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from the website, services, Academy content, delays, rescheduling, third-party services, or use of deliverables. Where liability cannot be excluded, liability is limited to the amount paid for the specific service or course giving rise to the claim.
Privacy
Personal information is handled under the Makwa Aerial Privacy Policy. By using the site or services, you agree that information may be collected and used as described there.
Governing Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, unless another mandatory law applies.
Changes
Makwa Aerial may update these terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the site, Academy, or services after updates means you accept the updated terms.
